When a new company is established or when the name of an already existing company is changed, it is necessary to have a Central Companies Registry Certificate which confirms that the sought company name is not being used by another company. We can obtain said Certificate on your behalf from the Central Companies Registry located in Madrid through customized management where we would first advise you about the suitability of the sought name as well as the other three names that can be requested at the same time included in a single fee. We can also obtain a non-certified extract from the registry which, before requesting the Certificate shows the possibilities of obtaining the certificate. We can get this non-certified extract from the registry immediately and send it to you by fax or e-mail as soon as we receive it. Trademark law in force establishes the prevalence of a registered trademark over the later registration by a third party of a company name conflicting with the earlier trademark. It is important to take into account that these disputes come about when the new company has been active in trade for some time and is then detected by the earlier trademark holder, who may then demand that the company name be changed. This can involve a huge economic loss as well as a loss of prestige in the eyes of the company’s clients. We therefore advise, before establishing a new company, that you also check and see if the sought company name is already registered as a trademark by a third party. Furthermore, if the sought name is free, the company name should then be protected as a trade name and/or trademark, which affords you appropriate protection against third parties and ownership of the most important asset, i.e. the distinctive sign of your goods and/or services on the market.
